Republicans Are Failing Unless They Are Disrupting, Discrediting, And Destroying The Bureaucracy
For well over a century, we’ve all been told the progressives’ folk tale about the Jacksonian revolution: that he didn’t really get rid of any of the bureaucracy, but what he did do was he brought in a rabble, and created the spoils system. In this telling, the nation is essentially held captive by the crooks, by the cronies, until the heroes arrive: when the progressives ransom democracy for the passage of this little statute called the Pendleton Act.

The Pendleton Act (and all of its progeny that follow up through Jimmy Carter’s 1978 civil service reform), had essentially one goal, which was to insulate the civil bureaucracy from political accountability — to “protect” civil servants. Now, I think in fairness we would all agree that Jackson’s idea did fail. He had a novel concept: what he called a rotation in office, essentially term limits for civil bureaucrats.

We’ve never really come back to that concept. We want to terminate the actual democratically accountable leaders of the nation and leave the permanent Mandarin class (which some folks in this room belong to here in Washington) as an occupying army. The idea was good, and Jackson would say, “I don’t want the civil bureaucracy to remain a species of property for these people.”

But even by the numbers, Jackson only took out about 10 percent of the then-existent civil service, which by even the modest standards of 19th-century America, 10 percent was insufficiently small.

Priority No. 1: Take Out the Bureaucracy
The last thing I’ll just say really quick is for those of you who actually advise members of Congress or senators. There was a recent celebration at the institution which is still called publicly the University of California at Berkeley (which is not really much of a university anymore). Professors Lee Raiford and Ula Taylor gave a presentation on Berkeley’s purchase of a whole tranche of documents from J. Edgar Hoover’s tenure as director of the FBI. The documents are largely focused on the counterintelligence program, which was known as “cointelpro.”

The presentation from the professors in why Berkeley was interested in this tranche of documents was that it supposedly was confirmation of the systemic racism of the FBI from its inception through the duration of Director Hoover’s tenure. For my purposes, I think what’s fascinating is how they highlighted this line from an internal memo that Hoover authored to field agents where he said, “The obligation you have is to disrupt, discredit, and destroy the Black Panther movement.”

The advice I would give any of you who are advising members of Congress when you go to stage what are otherwise meaningless Kabuki-theater hearings [is this]. When you want to exercise oversight by asking the bureaucracy to provide the information that will then allow you to exercise your oversight authorities — unpack that one: The very people you’re supposed to be controlling are the ones you’re dependent upon for information — when all that’s happening, the mantra that you should have in mind is: We are failing unless we are disrupting, discrediting, and destroying these people.

Precisely, indubitably so. Unless and until that happens, it’s all just posturing, preening, and pissing into the wind.

They Promised “Safe And Effective”; We Got “Sudden And Unexpected”

I want everybody reading this to think of two numbers from asking you two questions:

Question #1) How many people do you know who died of COVID?
I first started hearing rumblings of a new Coronavirus emerging out of China in January 2020 (although it looks now like COVID was already circulating throughout the world by mid-2019).

When I got wind of it, I was emailing friends and colleagues to get N95 masks and to stock up on groceries and medications. It looked bad. By February I was probably one of the first people seen around town wearing an N95 mask. In March I started running a spreadsheet using R0, fatality rates and case-doubling times that were coming out of the CDC, the WHO, and shrieking hysterics like Eric Feigl-Ding.

When it was all unfolding, I was initially afraid. My rough model posited that by the end of May we’d have 442,368 cases with as many as 22,118 fatalities and that was just in Toronto. By the end of July, 1.7 million cases and 88,473 fatalities.

I laid out previously what happened and what turned me into a lockdown skeptic: every day I’d plug in the new case and fatality numbers from the city, the province and federal levels and by the end of May I realized that my model was bust. By fall I knew that case numbers were bullshit (it didn’t matter how many people tested positive on a PCR test) and that lockdowns were a bigger problem than the virus.

There weren’t going to be 88K fatalities across the entire country, let alone Toronto (the official fatality count now for all of Canada is 49.5K – and we also now know that most of those, upwards of 90%, were with COVID and not from COVID. Toronto had about 3.7K total fatalities in over two years).

I naively thought this was good news. Surely everybody was looking at the data and surely everybody could see by mid-summer, that even adjusted for seasonality and expecting another wave in the fall, this was nowhere near the THERMONUCLEAR LEVEL EVENT certain prognosticators were promoting.

We all know what happened instead: by fall it had become a full fledged religion and well on its way to mass formation psychosis.

On January 1st, 2022 I surmised that the pandemic was mostly over. During the main run of COVID I did lose about four people within my social circle, none from COVID or even with COVID. That figure doesn’t count another two people I knew about in my area who committed suicide under lockdowns.

So without diminishing the tragedy of any of those 49K Canadians who succumbed with COVID, my number for the first question is zero.

How can anybody be faulted for not knowing what to believe or who to trust?
With the conventional narratives being so ephemeral and one “conspiracy theory” after another being validated (lockdowns, lab leak, vaccine passports…) is it any wonder people are becoming skeptical or outright distrustful of our institutions and media?

Given how many years they’ve been lying to us, about nearly everything under the sun, it’s dismaying that they’re only just now figuring it out.

General Michael Flynn: There Are Two American Governments, the Visible One and the SECRET One

And of all people, Flynn oughta know better than anybody, having had his life completely destroyed by it, for the unpardonable crime of working for and remaining loyal to President Trump.

You have probably never heard of it, but there is a parallel Supreme Court, of sorts, called the Foreign Intelligence Surveillance Court (FISC) that General Michael Flynn warns is operating “in almost total secrecy.”

A judicial panel that oversees American intelligence agencies in surveillance matters involving American citizens living in the United States, FISC first came on the public’s radar during the investigation that was launched against the 2016 campaign of former President Donald Trump.

FISC operates as a type of secret police, Flynn further insinuated with a quote from former Sen. Frank Church (D-Id.), who back in the 1970s said that “hiding evil is the trademark of a totalitarian government.” Church further stated that:

“There is no more pernicious threat to a free society than a secret police…operating beyond the law…if these abuses had not been uncovered and had the agencies gone unchecked, we might well have seen a secret police develop in the United States. Once that begins, the Constitution is in very real danger.”

It turns out that Church was right, and his warnings came true. At the dawn of the year 2023, technological advancements, among other things, have allowed the federal bureaucracy to massively expand – its tentacles now reaching into every crevice of American life.

True, observably and beyond all debate. Yet still many of us slumber, seemingly beyond all hope of awakening. New category exclusively for this sort of thing: The Shadow State.

Thinking ahead

Make no mistake here, folks: what we just saw with the gas-stove trial balloon is part of a process, a long-range plan.

Progressive cities such as Berkeley, San Francisco and New York City have already banned gas stoves and other appliances in new buildings. New York Gov. Kathy Hochul this week proposed a ban on gas equipment including stoves in new small buildings in 2025 and larger ones in 2028.

Come 2030, New Yorkers won’t be allowed to replace their gas stoves with new ones if they break down. “As you begin making a transition, everyone will have to switch out appliances,” a state official explained. This is how the left’s green-energy “transition” will work for all things. Come 2035, New Yorkers and Californians won’t be able to buy new gasoline-powered cars either.

The Biden Administration is also aiding and abetting the anti-gas stove cause. Last year it filed an amicus brief with the Ninth Circuit Court of Appeals supporting a gas ban by Berkeley, Calif. The departments of Justice and Energy argued that cities and states should be able to exercise police powers to prohibit the use of “dangerous or unsafe items.” Why would the federal government weigh in on a local regulatory case, if not for ideological climate solidarity?

Rest assured, it’s not just about Climate Change (formerly Global Warming, formerly Global Cooling, formerly The Weather)™ alone. That’s just cover, a ruse. Rather, the CC agenda itself is part and parcel of the tyrant’s eternal ambition to let nothing escape his gaze or his grasp.

Progressives claim that gas stoves produce pollutants that are harmful to human health. But pollution comes from cooking with poor ventilation, not from natural gas. Electric range-tops have the “hidden hazard” of potential burns, to borrow Mr. Trumka’s words.

There really is a culture war coming over gas stoves, and everything else involving fossil fuels, because climate has become for the left a matter of core cultural identity. Progressives want to impose their values on the lifestyle of everyone else, including in the kitchen. If subsidies don’t work, coercion follows. When they can’t win the political debate, they resort to brute government force. They really are coming for your stove.

Along with everydamned thing else. Remember: there is NOTHING they won’t try to fuck with, take over, control, and ultimately, ban. Nothing. It’s who they are, it’s what they do.

The Biden administration has just extended its COVID scam, the “emperor’s new clothes,” by renewing the declaration of Public Health Emergency. A recent poll shows that 52 percent of Americans still think the U.S. is in grave danger from COVID. Is that true? Was it ever? Is Washington’s COVID narrative and response plan good medical science?

Cliff’s Notes version: No, no, and oh, HELL no.

When one applies the scientific method to data about COVID, vaccines, and Washington mandates, one conclusion is inescapable.  Everything Washington said and did was wrong and unscientific.

The first and most egregious official medical falsehood represented that COVID was a grave national health hazard.  The danger was massively exaggerated.  For the healthy adult population, the chance of death because of COVID infection is similar to the seasonal flu.

Only elderly and immuno-compromised Americans, estimated at 2.3 percent of the population, are at serious risk of death due to infection with COVID.  The official number of “COVID deaths” is greatly exaggerated.  Autopsy studies and CDC demographic data show that 73 to 88 percent of these COVID deaths were people who died not from COVID, but because of multiple pre-existing conditions — cancer, kidney or heart failure, chronic lung disease, autoimmune conditions like rheumatoid arthritis.  While all COVID deaths had a positive test, only six percent had no pre-existing comorbidity.  COVID deaths included a 55-year-old motorcycle accident victim because a blood sample taken in the ER was positive.

Thus, 132,000 to 297,000 of the 1.1 million Americans reported as “COVID deaths” over two years actually died due to their viral infections.  Over two years before COVID, the CDC reported 140,600 deaths due to seasonal flu.  While any death is a tragedy, COVID never presented an existential threat to the nation.  Comparing COVID to bubonic plague represents ridiculous unrealistic hyperbole.  It is Washington-generated disinformation.

Children are a special case, an example of Washington’s medical malpractice.  According to CDC data, the risk of death from COVID in those under 18 years of age is less than 0.03 percent.  Their natural or inherent immunity provides better protection than any vaccine against any disease known.  PSAs urging parents to vaccinate their kids — “safe, effective, and doctor approved” — were Orwellian speech from the book 1984.  The jab was not medically indicated, was more dangerous than the disease itself, and was approved only in the mind of a bureaucrat M.D., Fauci, who had never practiced medicine on a child in his career.

Before vaccines were available, clinical physicians sought treatment options for patients ill with COVID.  Ivermectin is an anti-parasite drug that also has anti-viral properties.  Despite decades of safe usage, both the FDA and the CDC issued advisories saying ivermectin was “not approved for treatment or prevention” of COVID.  Hospitals and pharmacies took this as an official prohibition and refused to allow physicians to prescribe the drug.  A Minnesota medical board sought to punish a physician for trying to save a dying patient with ivermectin.  The ivermectin story demonstrates the triumph of politically correct groupthink over medical science.

The mask mandate highlights the reason Americans lost faith in the Washington medical establishment and the COVID Response Team agencies and spokespersons: Dr. Fauci; CDC director Rachel WalenskyFrancis Collins, the infamous NIH censor-in-chief; FDA advisories; and Joe Biden.

At various times, Fauci said masks were unnecessary, were helpful, were mandatory, wear two masks.  He promised that masking would suppress contagion with COVID.  Biden consistently wore a mask before cameras, but not while visiting nonagenarians Jimmy and Rosalynn Carter.

A number of studies including CDC data proved that masks do not work.  Despite all this evidence, Fauci was seen nightly demanding we wear masks and keep away from each other (social distancing).  A mask became a medical talisman and obvious virtue signal.  Covering the mouth and nose proved that the wearer cared about others and believed in a benevolent government, and that Fauci was using good science to keep us safe from a deadly danger.  A mask was one’s entrance ticket (while keeping your distance, please!) into stores and clinics.  No mask, no food.

Not only do masks fail to provide protection against COVID, but they can cause harm.  Adverse effects of masks were not investigated by mask-mandaters.  One study of children’s masks revealed a number of dangerous pathogens, ones that cause tuberculosis, meningitis, diphtheria, Lyme disease, and others.  It is troubling that such studies were not done by the CDC or NIAID (Fauci).  The report was initiated and paid for by the parents of children in Gainesville, FL.

Additional adverse effects of masking were neither studied nor quantified by Washington.  Education was severely impaired as children could not see the facial expressions of teachers or fellow students.  Masking makes business communication inefficient.

Mandatory social distancing, closures of schools and businesses, and prohibition against gatherings effectively produced national quarantine through quasi–martial law.  Lockdowns were implemented purportedly to “flatten the curve” of illness and reduce the burden of COVID patients on limited medical resources.  Cost/benefit analysis of lockdowns was strongly negative.  There were no established benefits.  There were devastating costs: social, economic, medical, and loss of constitutionally guaranteed freedoms.

Never before in history have physicians quarantined a healthy population during a pandemic, and for good epidemiologic reason: it doesn’t help.

Hate to say I told ya so and all, but…well, I did.

There’s more still, of which you should read the all, then pass the link on to at least three (3) friends and insist, adamantly, that they read it also. Every American must be made fully cognizant of how thoroughly they were played by TPTB:

    • Driven like sheep into blind, irrational panic over a phony “plague” that posed no serious threat to the overwhelming majority of them
    • Used as lab rats for an untested genetic-manipulation drug misrepresented as a “vaccine” whose only quantifiable effect is the permanent, polysystemic havoc it wreaks on their bodies
    • Abused by having their freedom of movement rescinded, in brazen defiance of the US Constitution, both in letter and in spirit; their independent businesses destroyed; their livelihoods taken from them; and their entire lives—personal, professional, familial—wantonly shattered by government, the “health” “care” megalith, and Big Pharma, for no good reason whatsoever
    • Impoverished, for generations to come if not for all time, by the needless damage wrought upon a previously humming economy and its supply chain entire by two years of the “fifteen days to flatten the curve” lockdown ploy
    • Deceived, completely and intentionally, from start to finish of this incredibly destructive psy-op

American anger must be stoked to its fieriest level ever by these ugly realities. Then, Americans need to turn that anger like a flamethrower on all those responsible for perpetrating these monumental crimes, all of whom have names and addresses—for the sake of a few extremely desirable ends: 1) creation of a prophylaxis to ensure it can never happen again; 2) righteous retribution against their tormentors, a thing formerly referred to in this country as simple justice; and C) restoration of the dignity and self-respect these wicked, brutish ogres robbed them of so audaciously.

German court orders Holocaust survivor to be sent to psychiatric institution for forced COVID shots

STUTTGART, Germany (LifeSiteNews) – German authorities want to put a famous Jewish composer and Holocaust survivor into a psychiatric clinic and force her to take the COVID injection.

Inna Zhvanetskaya, who lives in Stuttgart, Germany, was supposed to be taken to a psychiatric institution and forcefully injected with the COVID jabs on January 11, according to the news outlet Report24, which has been in personal contact with Zhvanetskaya.

However, according to several reports, she has been transferred to a safe place by friendly activists who wanted to prevent her arrest.

The 85-year-old Zhvanetskaya sent a video message to Report24 saying that “music is my life, and if they take away music from me then they take my life.”

Report24 also received a copy of the court order, which authorizes her forceful transfer to a psychiatric institution and for her to be forcefully injected with the COVID-19 shots “for her own good.”

The court order was officially appointed by her professional guardian, which seems somewhat contradictory given that the German national federation of professional guardians is strictly against forced vaccinations of patients against their wishes, according to statements made on their website.

“I talked to her on the phone for an hour,” Orel said, according to a report by TKP. “She is vulnerable, frightened, and has lived in this state for about two years, as her legal guardian has apparently tried to institutionalize her several times.”

It surely is–just EXACTLY like, I’m afraid. Which is nothing short of horrifying.

Professor Martin Haditsch, who was one of Austria’s most famous critics of the COVID-related government measures, said that the forced vaccination represents a violation of the Nuremberg Code, which forbids medical experiments on humans since the COVID injections were not properly tested before being introduced to the market.

Ironic, isn’t it? After all, Germany was the whole reason the Nuremberg Code came into being in the first goddamned place. Don’t make us come back over there again, assholes.

Some Illinois Sheriffs Say Departments Will Not Comply With Assault Weapon Registration Requirements

As potential legal fights percolate over Illinois’ new assault weapons ban, law enforcement officials in several counties have said that their departments will not enforce provisions of the bill that require existing weapons to be registered with the State Police.

Their arguments center around their stance that the bill, which makes it illegal for Illinois residents to purchase, transfer or manufacture assault weapons and extended magazines, violates the Second Amendment.

McHenry County Sheriff Robb Tadelman was one of numerous law enforcement officials throughout the state who shared messages on social media in the aftermath of the bill’s passage.

“Neither myself nor my office will be checking to ensure that lawful gun owners register their weapons with the state, nor will we be arresting or housing law abiding individuals that have been charged solely with non-compliance with this act,” he said.

Many of those law enforcement officials shared identical messages, including Kankakee County Sheriff Mike Downey, Sheriff Jack Harlan in Boone County and Winnebago County Sheriff Gary Caruana.

In a statement, Illinois Gov. J.B. Pritzker’s office called the messages “political grandstanding at its worst,” and said that sheriffs and departments that refuse to enforce the ban are “in violation of their oath of office.”

Au contraire, you rat-bastard prick; YOU are. Heartfelt kudos to these fine fellows; clearly, they understand their oath of office, the US Constitution, and their solemn and sacred duty to uphold it a damned sight better than their shitlib Goobernor ever will, or could.

“Insurrection” psychosis

The Shameful Exploitation of Brian Sicknick’s Death
Unfortunately, few seem interested in honoring who Sicknick was or allowing him to rest in peace. Shame on them all.

Joe Biden held a solemn ceremony at the White House to commemorate January 6 and present more presidential awards to some of the day’s “heroes”—recipients just happened to include several individuals who participated in the January 6 select committee’s televised performances. It was the first time Biden bestowed the Presidential Citizens’ Medal, an honor reserved for those “who have performed exemplary deeds of service for their country,” Biden said.

The ceremony in reality served as an opportunity for Biden to again perpetuate one of the biggest lies about January 6: that numerous police officers, including Capitol Police Officer Brian Sicknick, died as a result of the Capitol protest.

As a military officer read a brief summary of Sicknick’s military and law enforcement career, Biden held hands with Sicknick’s mother, Gladys, in attendance with Sicknick’s father to receive a posthumous award on behalf of their son.

“He lost his life protecting our elected representatives, upholding the will of the American people, and defending our Constitution,” a military aide said from the podium in the East Room on Friday. “For his service and his ultimate sacrifice, we the people honor U.S. Capitol Police Officer Brian D. Sicknick.”

But that isn’t what happened. Sicknick suffered two strokes caused by a blood clot near his brain stem; the D.C. coroner concluded Sicknick died of natural causes on January 7, 2021 at the age of 42. Rather than allow his family the chance to grieve with dignity and in privacy, the media immediately seized on his untimely passing to portray Trump supporters as cop killers.

Less than 24 hours after Sicknick died, the New York Times published an anonymously sourced account claiming Sicknick had been bludgeoned to death by protesters using a fire extinguisher. The paper retracted the story a month later but the damage was done; the notion that Sicknick died at the hands of Trump supporters became an animating feature of “insurrection” folklore, repeated to this day by the news media and federal judges handling January 6 criminal cases.

For example, during a court hearing last year, D.C. District Court Judge Emmet Sullivan berated a January 6 defendant for contributing to Sicknick’s death. “We had officers who died because of this,” Sullivan scolded Dustin Thompson before sentencing him to 36 months in prison for his role in the protest.

Actually, no, you fucking did NOT, you shameless liar.

The sideshow, according to a former fellow officer and longtime friend, does not properly reflect Sicknick’s legacy.

“He was the type of guy you would drop everything for to help if he needed,” Travis Page, who texted Brian the day of the protest, told me over the weekend. “He was very independent, very professional, very honest, very much did not like being the center of attention. He was hardworking, and he was a better man than me. And I don’t praise too many people in that way. He would absolutely hate being used in the political arena like people are doing.”

Page said Sicknick’s death is being used by both sides to score points. “I know it’s cliché, but when he was laid to rest he sincerely would want that to be the end of talking about him. Lawsuits, half hearted ceremonies, political tug of war, it’s not what he would have wanted,” he said.

It’s disgusting; the whole damnable J6 shitshow entire is a blot on Amerika v2.0’s escutcheon which won’t soon be lived down. Meanwhile, in other news, Ashli Babbitt, murdered in cold blood by a trigger-happy, cowardly Capitol Gestapo pusnuts, is still dead. Next time they descend on Mordor On The Potomac en masse, Real Americans will hopefully provide a firm reminder of that to those desperately in need of one.

And so they issued a “clarifying statement” that they were just totally kidding when they said they were considering banning gas stoves.

This is the funniest and most blatant habit yet of the Left picking a fight out of nowhere and then blaming normal people for waging a “culture war” when they push back.

They do this all the time. It’s a standard tactic of totalitarianism. When the Party launches a political crusade, and you resist, YOU’RE the aggressor. If resistance actually thwarts the crusade, you’re a monster. If you question the New Truth of the Party, YOU’RE the attacker.

This is happening even faster than I predicted yesterday, probably because the War on Stoves trial balloon exploded in flames while the lefties were still downloading their new programming. They’re confused and angry.

You had lefty blowhards on Twitter in the middle of shouting their new War on Stoves talking points yesterday when the Biden administration suddenly backed down. It’s like pulling the chip out of a Terminator while it’s in the middle of emptying a magazine at Sarah Connor.

Look at how prominent dingbats like AOC played it, with classic Orwellian “we have always been at war with Eastasia” full-steam ahead gusto: We have ALWAYS known gas stoves were dangerous. Everybody knows this. It has ALWAYS been an urgent crisis.

This started a few days ago with a single Biden apparatchik floating a ban based on a fraudulent “study” from a whack-job activist group, but they were told to believe it was some longstanding consensus and THANK GOD SOMEONE IS FINALLY THINKING ABOUT THE CHILDREN.

The only way to salvage that half-downloaded program still bubbling in the heads of so many lefty robots is to concoct a new narrative that says the opponents, the resisters, ATTACKED and are OBSESSED and were probably organized by paid stooges of Big Stove and Big Gas.

It’s the same tedious, but far too effective, playbook they use with every social issue, a totalitarian method of shifting the political landscape by claiming every bit of ground you aggressively seize has been yours forever, and those trying to take it back are the attackers.

Hmm, now let me see here.  The actual statement:

Consumer Product Safety Commissioner Richard Trumka, Jr., told Bloomberg in an interview this week that a ban was “on the table” for gas stoves, which research has linked to health problems including asthma.

Products that can’t be made safe can be banned,” Trumka told the media outlet. Trumka also highlighted the health dangers of gas stoves in an appearance last month before the Public Interest Research Group.

“We need to be talking about regulating gas stoves, whether it’s drastically reducing emissions or banning gas stoves entirely,” Trumka told PIRG, adding that a ban “is a powerful tool in our toolbox and it’s a real possibility here, particularly because there seem to be readily available alternatives already in the market.”

The law is a ass

So the Houston taqueria shooter has foolishly contacted Houston Homicide, exactly as I hoped and prayed he wouldn’t, rather than heading across the border into Mexico and laying low for awhile as he should’ve done. The case has been referred to a grand jury for further investigation. Legal Eagle Andrew Branca, whose email list I’ve been a subscriber to for a good while now, deep-dives into Texas self-defense law and the facts as we know them from the vid, and comes up with the likely outcome.

SPOILER alert: it isn’t pretty.

Although the shooter initially fled the scene, along with all the other customers, he has now reportedly retained legal counsel and is cooperating with the authorities investigating this event. It is reported that the case will be presented to a grand jury for consideration. The shooter has not been arrested, and as a result the authorities are allowing him to remain anonymous.

The question now, of course, is whether the shooter’s use of deadly defensive force to stop Washington’s armed robbery was justified on the legal merits.

The answer? Yes, maybe, and almost certainly not.

Confused yet? Let’s clarify.

BASICS OF LEGAL JUSTIFICATION FOR USE OF DEADLY FORCE UNDER TEXAS LAW

Shooting someone dead is, of course, normally a crime. Under Texas law, and the law of every other state, however, the use of deadly force upon another might be legally justified, and not a crime, if it meets the conditions for deadly force defense of persons—meaning either defense of self or defense of others.

Additionally, and unique to the Lone Star state, the use of deadly force upon another might be legally justified even in defense of mere personal property—again, if the required legal conditions have been met.

Importantly, the legal conditions for justification must be met for each individual use of deadly force in the encounter—meaning, in this case, for each round fired by the shooter–and that’s where we arrive at the “yes, maybe, and almost certainly not” nature of whether this shooting is lawful.

The bottom line, of the nine rounds fired by the shooter at Washington, the first four were almost certainly legally justified, the second four may be legally justified, and the ninth and final shot almost certainly was not justified, based upon the only evidence currently available to us, which is the surveillance video of the encounter.

For purposes of this commentary and legal analysis, I’ll be addressing the shooter’s use of force as three distinct use of force events, each needing their own legal justification in order to be lawful.

Use-of-Force #1: The first four shots fired, roughly from the start of the video to 0:10 seconds.

Use-of-Force #2: The second four shots fired, roughly from 0:10 to 0:14 seconds in the video.

Use-of-Force #3: The ninth and final shot fired at about 0:16 seconds in the video.

The verdict? Based on Branca’s meticulous legal analysis, that ninth shot will probably doom RS in court, and I concur with utmost regret. But Branca being a modest sort (“But I’m just a small-town criminal defense attorney…”), he proffers a small caveat:

So, given the apparent lack of legal justification for that ninth and final shot, potentially an unjustified unlawful killing, does that mean the shooter in this case will be indicted, prosecuted, and convicted?

The answer is: Who knows?

What I’ve shared above is a legal analysis of this shooting, and it’s one I have great confidence in the legal merit of that analysis.

Questions about indictment, prosecution, and conviction, however, have considerations beyond legal merit.

A prosecutor’s office will typically be asking two distinct questions in evaluating how to handle such a case.

First:  What can we do, based on legal merit.

Second: What do we want to do, based on political considerations.

It’s not at all uncommon for prosecutors to use their discretion to give a break to an otherwise law-abiding armed citizen who may have been a bit sloppy in their use-of-force from a technical legal perspective.

The danger, of course, is the use of that discretion is far outside the defender’s own control–he’s now put his fate, potentially the rest of his life, in the hands of other people.

Perhaps they’ll use their discretion in a way favorable to the defender…but perhaps they won’t.

Political considerations are bound to loom particularly large here, given the rioting, burning, and all the usual trimmings amongst Houston’s large Feral Dindu population which giving RS any kind of “break” will almost certainly touch off in its wake.

Bottom line: thanks to an incomprehensible, disastrous decision to come forward and place his fate on the dysfunctional, out-of-balance scales of “justice,” RS will wind up spending the rest of his natural life behind bars for the heinous crime of defending himself against a vicious thug. In a post-Constitutional Amerika v2.0 bereft of law; any semblance of fairness or propriety; interracial comity; and any sense of the overriding urgency of maintaining civic order, only a blind fool would ever do such a thing. RS’s apparent faith in the badly-broken Amerikan “justice” system to do right by him might be touching, but in the end, said misplaced faith will be his undoing. I hate it, really I do, but he’s well and truly fucked at this point.

Update! As it turns out, and to the surprise of exactly no one, Evil Perp had already claimed the life of one innocent victim in the course of yet another of his habitual crime sprees.

Court documents also confirmed that Washington was released on parole in 2021 for a conviction of aggravated robbery with a deadly weapon, for which he had been sentenced to 15 years behind bars. Washington had been convicted in 2015 in connection to the murder of 52-year-old Hamid Waraich, the owner of a Boost Mobile cell phone store, who was fatally shot in the back during a robbery. He was paroled in 2021 after serving six years. One of the victim’s sons, Sean Waraich, called Washington ‘an evil criminal that took joy from harassing and robbing innocent families.’ He called the taqueria vigilante a ‘true hero,’ and said he ‘did the right thing in stopping the robber and protecting the community from a dangerous perpetrator.’

Aman Waraich, another son of Hamid, said: ‘If the guy who stopped Eric was around 10 years ago, maybe I’d still have my dad.’

Precisely so, tragically so. The simple truth of this young man’s plaintive, heartbroken words will resonate for years to come, in stark condemnation of a warped and upended system of revolving-door “justice” that would even dream of prosecuting Righteous Shooter. Washington was (sub)human detritus—garbage, nothing more nor less. RS is “guilty” only of taking out the fucking trash, a bit of housekeeping which was long overdue.

The REAL crime here is that EP was freed to walk the streets robbing, assaulting, and killing, instead of being behind bars where he should have been, and belonged. When might we expect to see that referred to a grand jury, I wonder?

So where are the FBI SWAT teams? Will they be raiding Joe Biden’s private office at the Penn Biden Center for Diplomacy & Global Engagement as they raided Mar-a-Lago, Donald Trump’s Palm Beach home? Of course not. Sure, it turns out that there were classified documents in Biden’s office dating from his time as vice president. But only Trump and Trump-friendly people get the full klieg treatment from the Deep State’s Geheime Staatspolizei. We do not yet know exactly what is in Biden’s documents, though news reports acknowledge that some of the material was marked “sensitive compartmented information,” also known as SCI, a designation used for “highly sensitive information obtained from intelligence sources.” Late-breaking news specifies that at least some of the material has to do with Ukraine, Iran and the UK. Top secret stuff, in any case.

Back when Trump’s house was raided, the media was rife with speculation that the classified material might include “nuclear secrets.” They haven’t dared to air such speculation this time around.

“Haven’t dared”? No, they have no desire to. And why would they, prithee tell? That would be like an NFL offensive lineman or center turning around after the snap and sacking his own quarterback. Oh sure, it’s always a possibility, but it ain’t the way to bet.

What should we make of this latest episode? Two things. On the one hand, it is yet another illustration of the two-tier system of government into which America has devolved. There is one law for the elite, quite another for you and me. On the other hand, the revelation just might inaugurate a little carpet raising, allowing the world to get a glimpse of what “the Big Guy” has been up to in his business dealings.

Fat chance of that. Not with a D卐M☭CRAT junta in power, a compliant media establishment, and a wholly complicit, collaborationist “opposition” Party charged with doing the notional rug-raising. Far more likely that the whole contretemps will be quietly swept under said rug, with alacrity.

It is not without interest, for example, that the “Biden Center for Diplomacy and Global Engagement” at the University of Pennsylvania came into being with a hefty injection of Chinese cash, more than $50 million of the crispest. Inquiring minds might want to look into the penumbras and emanations of that bit of largess directed at the then-vice president of the United States.

Would that we had any of those handy, in Jurassic Media or the goobermint either one. Unfortunately, we most assuredly do not. Which is a whole ‘nother problem altogether, one that will have to be addressed eventually.

Joe Biden Awards Infamous 2020 Election Workers With Presidential Citizens Medals

Ruby Freeman, the notorious election worker who was caught on surveillance video engaging in highly suspicious activity during the 2020 election in Atlanta, Georgia, was awarded the Presidential Citizens Medal at the White House on Friday.

During a White House ceremony recognizing the 2nd anniversary of the January 6 riot, Biden honored Freeman, her supervisor daughter Shaye Moss, and ten other individuals.

The White House portrayed Freeman as voting rights heroine who had suffered cruel right-wing harassment in the aftermath of the election.

“Inspired by the voting rights legacy of her beloved Atlanta, Lady Ruby Freeman viewed her civic duty as a Fulton County Election worker as a sacred mission so the people of Georgia could exercise their fundamental right to vote freely and fairly,” a White House staffer said during the award ceremony Friday.

Freeman and her daughter were seen on the surveillance video pulling boxes filled with ballots out from under a table at State Farm Arena after supervisors had told poll workers they had quit for the night.

After Freeman, Moss and another election worker retrieved the ballot boxes from underneath the table, the video shows Freeman and Moss scanning and rescanning stacks of ballots into an election computer.

The presidential race in Georgia in 2020 was decided by less than 11,900 votes. Election investigators estimated at the time that the late night ballot scans added between 20,000 to 40,000 to the overall vote totals.

It’s long, but be sure to read it all; it truly, truly beggars belief. So much so, it’s bound to leave you absolutely slackjawed, the final two ‘graphs especially.

BOMBSHELL POLL: 66% of Texas Voters Want TEXIT

According to a newly released poll by SurveyUSA, a top-rated pollster, 66% of likely Texas voters want Texas to withdraw from the union and “become an independent country.”

The bombshell poll was conducted in eight states, including Texas, Alabama, Mississippi, Louisiana, South Carolina, Florida, New Hampshire, and Hawaii. Support for exiting the union polled highest in Texas, with regular voters showing 66% support and voters who vote only in presidential elections showing 63%.

The poll results shouldn’t surprise supporters of the Texas Nationalist Movement. TNM President Daniel Miller has publicly stated that he believes a TEXIT referendum result would be 60%-65% in favor of Texas reclaiming its status as an independent nation.

69% of Texas voters who expressed an opinion want Texas to hold a referendum on separating from the US, including 81% of Republicans. These numbers support the recent vote by delegates to the Republican Party of Texas Convention, who voted 90.08% in favor of a platform plank that calls for putting the TEXIT question to the people of Texas.

With or without a vote, 60% of Texas voters who expressed an opinion want Texas to set a date for a complete withdrawal from the union. 70% of Texas Republican adults who expressed an opinion agreed.

They can want it all they like, but wanting ain’t getting, alas. Lest anyone forget, we already fought one war over this sort of thing, and FederalGovCo has only gotten bigger, greedier, more powerful, and more tyrannical since then. If Texans truly do want their freedom and independence…well, there’s only ever been just the one way of achieving that, really. Thomas Jefferson knew it well enough.

What country can preserve it’s liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms. The remedy is to set them right as to facts, pardon and pacify them.

And that’s the long and the short of it.

Chaos in Brazil: Protesters Storm Capital, Destroying Supreme Court and Congress

Thousands of opponents of socialist convicted felon President Luiz Inácio Lula da Silva stormed his offices and the headquarters of the Congress and Supreme Federal Tribunal (STF) of Brazil on Sunday, reportedly demolishing the facades of two of the three buildings and causing “irreparable” damage to priceless artifacts in the chambers.

The riot in Brasilia occurred while Lula himself was in Sao Paulo state assessing the damage of recent floods. Lula, in a public statement following police action to subdue the protesters, announced an official “federal intervention” in Brasilia – consolidating the public security powers of several agencies into the hands of a hand-picked, top-level official – and accused police of acting in “bad faith” in failing to prevent the protesters from storming the buildings.

The incident is an offshoot of months of protests following the October presidential election that saw Lula narrowly defeat then-incumbent President Jair Bolsonaro in two rounds of voting. Most protesters support Bolsonaro but, more broadly, oppose Lula’s victory as illegitimate on several grounds, including his multiple convictions on charges of corrupt acts occurring during his first two terms as president. An audit of the 2022 runoff presidential election, which featured only Bolsonaro and Lula as candidates, by the Armed Forces of Brazil concluded that no guarantee could be made of the absence of fraud or irregularities.

Protesters also accuse the STF, particularly its head justice Alexandre de Moraes, of intervening in the election by censoring mentions of Lula’s corruption case and silencing Bolsonaro supporters through fines and police raids.

Well, gee, that last bit doesn’t sound AT ALL like how we found ourselves stuck with dear old Pedo Joe as pRetend “pResident,” now does it?

Lula’s inauguration on January 1 occurred without major incident and Lula used his powers to immediately begin undoing Bolsonaro policies, most notably sharply limiting civilian access to firearms.

Proving yet again that gun-grabbing shitlibs are the same the world over.

Last month, Lula’s pick for justice minister, Flavio Dino, referred to anti-Lula protest groups as “incubators of terrorism.”

Nope, still not ringing any bells for me. Don’t know about you guys.

Many of the protesters convening in Brasilia on Sunday are part of a movement demanding that the nation’s military oust Lula. They insist that their demand is not for a coup d’etat, but for a “military intervention” they say the Brazilian constitution provides for in the event of an illegitimate election.

Some protesters shared videos on social media during the event on Sunday urging the military to “save us from communism.”

Sorry to be the wet blanket here, but I’m afraid that’s on y’all, same as it is here in the US. Vote your way in, shoot your way out, all that jazz.

A great mob of many thousands went apeshit in Brazil over the weekend in that country’s weird, geographically isolated capital, Brasilia, a horror of 1960s-style Modernist city planning. They stormed the national congress and trashed the offices within to protest the fishy election of President Luiz Inácio Lula da Silva over the former incumbent Jair Bolsonaro. As in our own country, the quarrel was over the mysterious behavior of voting machines and the unwillingness of election officials or courts to verify the results. The New York Times offered a thumbnail of Mr. Bolsonaro, who is sitting out the current action in Florida:

The resulting picture showed an elected leader, first as a congressman and then as president, who has built a narrative of fraudulent elections based on inaccuracies, out-of-context reports, circumstantial evidence, conspiracy theories and downright falsehoods — much like former President Donald J. Trump.”

Get it? There’s no way fraud could have happened, just like in our country. And Bolsonaro is another Trump. It explains everything. All complaints are “baseless,” “false,” and “conspiracy theories.” End-of-story…. Are these shopworn tropes maybe losing their mojo? And is The New York Times embarrassing itself, a little bit, to trot them out as if they are actually arguments against anything?

The truth is more that Mr. Lula is another Hugo Chavez, poised to wreck Brazil with a fresh attempt at nationalizing all enterprise, ramping up a Marxist police state, and inviting China to partner-up in the action, including new Chinese military bases in the western hemisphere — an interesting challenge to the Monroe Doctrine (if anyone remembers what it says). And so, Mr. Lula has arrested hundreds of protesters and declared a national emergency.

Don’t expect it to stop there. The protesters are asking the army to intervene, as Brazil’s constitution actually obligates them to do in election disputes. Also, unlike the USA, Brazil has plenty of prior experience with the army removing elected leaders. Sometimes, electing yourself into tyranny is not the best way to solve economic problems. For the moment, Mr. Lula borrows a page from the American Left’s playbook for destroying a society. It will matter a lot if he doesn’t get away with it. That’s why the US political Swamp, and its errand boys in the news media, look on the action in Brazil with alarm. Unlike the January 6 protest in Washington, the Brasilia mob represents a genuine insurrection aimed at overthrowing a communist seizure of power.

All well and good, until we go off the rails entirely, in the usual fashion.

Before long, the House is going to impeach Mr. Biden over this fiasco and quite a few other matters. He may not be convicted in the Senate, with its slim Democratic Party majority, but they will be compelled to hold a trial, at least, where a lot of dirty laundry will get aired, and pressure will mount for the old grifter to resign.

Hoooooo-KAY, then. Don’t let’s anybody be holding their etc waiting for THAT Skittles-pooting unicorn to turn up, that’s my advice.

Kevin McCarthy as de facto leader of the GOP is all the evidence necessary to realize the Uniparty Swamp is in complete political control. Pockets of opposition that occasionally pop up get burnt and discarded faster than a Hunter Biden crack pipe.

The GOP is the marginally-less-horrible wing of the Uniparty Swamp. This political cabal owns DC, or to be more accurate, they manage DC and do whatever they’re told when they get calls from Beijing, Davos, or Hell.

American people have absolutely zero influence over DC today.

The election system is completely corrupted. Legislation is bloated to thousands of pages so politicians can “earn” their payoffs from special interest groups by sneaking in the taxpayer-funded pork. The bureaucratic state is a cesspool.

The McCarthy-run GOP bathes in all this.

Only God can save this nation.

Alas for us all, so far He seems entirely disinclined to do so.

Few in DC deserve our support and even fewer deserve our respect. Unless we can somehow break free from the system, we will always be slaves to it. The system is worse than corrupt. It’s irreparably broken. And that’s the point. They WANT it broken to cover up their ineptitude.

Nah, they don’t much care about that, as long as the moolah keeps flowing their way and their power remains effectively unchallenged by us lowly Proles. Alternate view: it isn’t  so much the system that’s broken, at least not the original one envisioned by the Founders; the grubby, grasping swine who perverted that one into the misbegotten mess we now suffer under are what’s broken here. THEY’RE the ones that can’t be fixed, which means they need to broken for real—into little bitty pieces, so badly that the mere thought of ever trying to fuck with us again causes them actual physical pain.

JD is correct, though; Swampy McCarthy is almost certainly going to wind up as SOTH, and he’s going to get cracking right away on breaking every false promise and reneging on every shady deal he used to maneuver himself into the position of power he so desperately lusts after. That indeed does put the writing on the damned wall for all with eyes to see, all the proof anyone should ever need about the true nature of the federal Leviathan-state, and that there really is no voting our way out of this.
