THE UNBEARABLE TAX EVENT OF BEING
Q: I just want to know where, in your opinion, does the Constitution give specific authority for Congress to give an individual mandate for health insurance?
LEAHY: What — we have plenty of authority. Are you saying there is no authority?

LEAHY: Why would you say there is no authority? I mean, there’s no question there’s authority. Nobody questions that.

LEAHY: Where do we have authority to set speed limits on an interstate highway?
Q: Well, the states do that.
LEAHY: No, no, the federal government does that.
No, it doesn’t. But that’s not important now. There’s something missing there–did you catch it?
By my count, that was three Bare Assertion Fallacies, two of which are also False Generalizations, and three Answering a Question with a Question, one of which is also a Red Herring. And a partridge in a pear tree.
But never an answer to the question

I question it. And Leahy knows that others question it, as well. It would immediately be the subject of litigation. He’s just trying to bully his way through now and poison the well for later.
Boehner said: “Well, I’m not a lawyer and I’m certainly not a constitutional lawyer, but I think it’s wrong to mandate that the American people have to do anything.
“The government has never required people to buy any good or service as a condition of lawful residence in the United States,” said the CBO report.
He also knows there is no authority for this tax in the Constitution he freely and falsely swore an oath to defend. And not just the tax but also the mandate. Ed Morrissey:
In fact, plenty of people question whether the Constitution allows the federal government the authority to mandate any kind of purchase. It gives Congress the authority to regulate interstate commerce, but that wouldn’t apply at all — because the federal government blocks the interstate sale of health insurance at the moment.
They had to pass an amendment to tax income in 1913–there was no grant to the federal government in the Constitution to tax income, the Court ruled. There is no Constitutional permission for this either, unless you ARE interstate commerce, in which case you may be regulated. Eliot Spitzer’s escorts don’t count. Even if they did, there’s a difference between prostitution and this proposed Individual Mandate Tax. As mojo noted
“Commerce” is not a forced purchase. It is making a voluntary transaction with a seller for an agreed-upon price. A forced purchase is “extortion”.
This is not like auto insurance. You don’t have to operate a car. But you have to operate you body. Cars are property. We are not–not yet, anyway…but we’re getting there.
If you don’t want to pay Income Tax, you can not have income. If you don’t want pay sales tax, you can avoid the purchase. If you don’t want to pay the Death Tax, you can declare yourself a government program and live forever.
But this is the first ever tax on the individual just for existing.
Despite any pretty words to the contrary, payroll taxes are extensions of the income tax and go into the general fund. Democrats could easily fund this debacle through general revenues, but they would have to openly raise taxes and they hate being held responsible for tax increases. That’s also why this is called a “fee” or a “mandate”.
In the 70’s, they hid tax increases by spending money and paying it back in “inflation” dollars. Reagan:
“When a business or an individual spends more than it makes, it goes bankrupt. When government does it, it sends you the bill. And when government does it for 40 years, the bill comes in two ways: higher taxes and inflation. Make no mistake about it, inflation is a tax and not by accident.”
Democrats have let trial lawyers build their fees into all goods and services, a hidden tax in which Democrats receive part of the ransom. And they also crave a Value Added Tax because it’s hidden.
So, is this an individual mandate tax designed to pay for Health Care…or a health care plan designed to get an Individual Mandate Tax?
The answer to the question is “Yes.”
They want both. The control over everyone that comes with Socialized Medicine, the money and the power–not to mention all the goodies they’ve loaded up for unions, trial lawyers, Planned Parentless, the Race Industry, etc.
Being able to create out of thin air a federal right to tax individuals just for existing and to compel purchases is an unparalleled power grab by the State. It is arguably a bigger prize than even Socialized Medicine giving politicians control of your health.

Stop the Hurt.
The honorific “Leaky” springs from times Leahy used his committee post to leak state secrets to our enemies in his own ad hoc program of Socialized Treason. Even Democrats agreed he must be thrown off the committee.
In 1986 Leahy leaked secret information about a covert plan by the Reagan administration to overthrow Libyan dictator Muammar Qadhafi. A few weeks later, details of the plan appeared in The Washington Post, and the operation was canceled.
Rather than discuss his concerns in private, or even privately threatening the Reagan administration with disclosure, Leahy chose to warn Khadffi on the front page of the Washington Post. That’s right–Gadafi is still in power today because Leahy and the Post kept him there.
Shockingly, rather than expressing gratitude to Leahy and the Post, however, Gaddafy was angry. Couldn’t have predicted that.
Leahy showed weakness and a divided front before the enemy, already stung by Reagan’s air strikes in retaliation for murdering our GIs. He gave Qadoffi even more motive to seek revenge while assuring his continued rule.
And before you know it, a Pan American jetliner was laying in pieces on the ground at Lockerbie.
And now “Lockerbie” Leahy is handing out free Constitution classes.
