The Banana Republicization of America

The America that has flourished for more than two centuries is being quietly but steadily dismantled by the Obama administration, during the process of dealing with particular issues.

For example, the merits or demerits of President Obama’s recent executive order, suspending legal liability for young people who are here illegally, presumably as a result of being brought here as children by their parents, can be debated pro and con. But such a debate overlooks the much more fundamental undermining of the whole American system of Constitutional government.

No President of the United States is authorized to repeal parts of legislation passed by Congress. He may veto the whole legislation, but then Congress can override his veto if they have enough votes. Nevertheless, every President takes an oath to faithfully execute the laws that have been passed and sustained — not just the ones he happens to agree with.

If laws passed by the elected representatives of the people can be simply over-ruled unilaterally by whoever is in the White House, then we are no longer a free people, choosing what laws we want to live under.

Bingo.

When a President can ignore the plain language of duly passed laws, and substitute his own executive orders, then we no longer have “a government of laws, and not of men” but a President ruling by decree, like the dictator in some banana republic.

Bingo.

When we confine our debates to the merits or demerits of particular executive orders, we are tacitly accepting arbitrary rule. The Constitution of the United States cannot protect us unless we protect the Constitution. But, if we allow ourselves to get bogged down in the details of particular policies imposed by executive orders, and vote solely on that basis, then we have failed to protect the Constitution — and ourselves.

Bingo.

There have been many wise warnings that freedom is seldom lost all at once. It is usually eroded away, bit by bit, until it is all gone. You may not notice a gradual erosion while it is going on, but you may eventually be shocked to discover one day that it is all gone, that we have been reduced from citizens to subjects, and the Constitution has become just a meaningless bunch of paper.

Bingo.

If Obama gets reelected, he knows that he need no longer worry about what the voters think about anything he does.

Worse: he will know that enough of them agree with his intention to transform America–and that America truly is no longer America, because Americans are no longer Americans in any but the geographic sense. And so will we all know it, and can then begin taking whatever steps are necessary to sever our ties to them.

I’ll bring enough for my brood, with some to spare for my gracious soon-to-be-host. But seriously, this scares the ever-lovin’ shit outta me, and not just FOR me, but my kids and grandkids. I truly believe we are living in the dying days of Freedom, and that, my ol’ buddy, is hard to fathom.

    It wasn’t an executive order, but an exercise in prosecutorial discretion.

    No President of the United States is authorized to repeal parts of legislation passed by Congress.     However, this was well within the president’s powers. There are far more immigration cases than resources to prosecute them. It’s similar to a local prosecutor who decides that someone caught with a small amount of marijuana should be sent to counseling rather than jail. It doesn’t mean the prosecutor is acting outside the law. It’s within the norms of prosecutorial discretion.

    The Constitution of the United States cannot protect us unless we protect the Constitution.

    That can be done by taking the president to court. However, the suit would fail, because the president is within his executive prerogatives.

You must believe we’re all a bunch of fools to believe that he doesn’t have the resources and is choosing some cost effective measure by subjectively enforcing certain laws over others. Not when we have trillion dollar deficits! Otherwise, just ask Congress for more money and resources to enforce this law. It’s not it’s a budget buster, like Obama would care about busting a budget that’s already bustin’ out all over!

    It’s a pure political decision. He wants amnesty but he can’t get his policies passed through Congress. So he’s end running Congress. As Mike said, unconstitutional in its intent (end running Congress) and its effective result (effective amnesty for those that should be prosecuted under the law of the land for as long as this selective enforcement policy is in effect).

    Otherwise, let me know where in the Federalist Papers it was contemplated that the President could ignore the laws passed by Congress for any reason and remain Constitutional.

    Again, if the president is violating his constitutional responsibilities, then he can be taken to court to force compliance. But the action won’t win, because the president is within his authority.

  5. That dog ain’t hunting bub. Obama is so clearly violating the limits our Constitution places on each branch I find it hard to believe anyone can defend him.

    What about DOMA? A legally passed law that Obama directed his DOJ to ignore.

    What about Obama declaring the senate wasn’t in session to appoint 4 hacks to NLRB when the senate was in fact in session.

    What about the legions of Class C bureaucrats he’s appointed that are writing 1,000s of BINDING regulations, totally circumventing Congress? Do you know that on top of raising the Federal’s government grab of GDP from 18% to 25%(on track to be in the low 30%s in 10 years) these regulations are an additional drag of 12% of GDP.

    In the mid 50s, Eisenhower initiated Operation Wetback. In addition to the almost 100,000 illegals that were caught and deported, over 1,000,000 illegals SELF DEPORTED. If our spineless pols put their mind to this hideous trampling of our laws by illegal aliens, a very similar result could be achieved.

    But it does not matter. The rule of law is already so compromised by this culture of corruption and the “Chicago Way” thuggery that I would not be surprized if folks started voting with bullets should Odorkma be re-elected, sad as that would be.

    But that does not matter either, since the public debt is so large at 16+ trillion, that a mere 4 percent increase in it’s interest rate would wipe out ALL federal tax receipts completely, leaving nothing to pay for any federal program like say the army or FBI or congressmen, let alone food stamps, welfare, women’s abortions, social security, global smarming, etc. That should make for interesting times.

    Perhaps Zach, you at least would taste good !

    This is how it will go down. Little by little. One at a time. Then, a few at a time. None with media coverage.

    Sure it matters. A claim was made that Obama’s action on immigration was unconstitutional. The claim was false.
